Buying a home is an exciting prospect and the right solicitor can help the process run as smoothly and stress-free as possible. Our solicitors are all experienced in the process of selling and buying properties and you can trust in their expertise to make the whole process a little easier for you. The following information should give you a basic idea of what to expect from the legal process when buying a property.
We will initially ask you for certain important information and documentation needed in order to commence the process to include:
Your personal identification
Details of the property you wish to sell or buy
Your ideal timescale
Your arrangements for financing your purchase
We will then obtain the details of the property from the seller's solicitor and undertake the necessary checks and searches to ensure that you are buying a secure investment.
We will keep you updated with each step taken in the process and once all of our searches and investigations are completed we will provide you with a comprehensive "property report" giving you the important information about the property you are purchasing. If you are happy with the property and wish to proceed we will ask you to sign the contract, at which point you will need to provide us with a deposit which is usually between 5% and 10% of the total purchase price.
The process known as "exchange of contracts" is an important step in the house buying process. At the point at which contracts are exchanged you are legally contractually bound to proceed with your purchase of the property, and if you change your mind there would be financial penalties. At the point of "exchange of contacts" the date for completion of the purchase is agreed and fixed.
In readiness for the date of completion we will request your mortgage funds from your lender. We will also request from you the difference to include:
Stamp Duties
Land Registration fees
Search fees
Our costs and VAT
On the date agreed for completion we will then pay the remainder of the purchase price to the seller's solicitor and advise you when you are able to collect your keys from the estate agent.
After completion we deal with the essential formalities of payment of Stamp Duty and registering your ownership of the property with the Land Registry. We of course advise you once all this has been completed.
